Solidarity Legal Services’ Labour Court division provides a comprehensive range of services to Solidarity members. Disputes of members in terms of labour law which needs to be ruled in the Labour Court are also handled. The cases of individual and collective members are handled and services include consultations, merit determination, opinions and court papers are drawn up, exchanging plea documents, handling application of opposed motions, urgent applications and hearings.
Cases handled on behalf of members include retrenchments, discrimination, automatic unfair dismissal, review applications, appeals, breach of contract, declaratory orders and applications to turn an arbitration order into a court order.
This division also reviews unsuccessful arbitration incidents and defends merited review applications. Cases and incidents which cannot be settled during conciliation are referred to the Labour Court. Cases in which employers do not comply with arbitration orders are also handled by the Labour Court division. By means of an application procedure, a court order is issued which ensures that steps may be taken against the employer.
Solidarity’s Labour Court division comprise four litigants, two junior litigants and three administrators who endeavour to assist members of Solidarity.
